These Terms govern your access to and use of Pulpe. Please read them carefully: they explain your rights, our rights, and how we handle content and disputes.
Pulpe (the "Service") is operated by Pulpe LLC ("Pulpe", "we", "us" or "our"), a Limited Liability Company organized under the laws of the State of Wyoming, United States, with its registered address at 30 North Gould Street, Sheridan, WY 82801, United States. Publisher and host details are listed in our Legal Notice.
By creating an account, or by accessing or using Pulpe on the web or as a mobile web app, you agree to these Terms, to our Privacy Policy and to our Cookies Policy. If you do not agree, do not use Pulpe. If you use Pulpe on behalf of a company or organization, you confirm that you are authorized to accept these Terms on its behalf. These Terms are available in English and French; both versions have the same value.
You keep ownership of everything you post on Pulpe: text, photos, videos, audio, documents, stories, comments and messages ("Your Content").
To operate the Service, you grant Pulpe a worldwide, non-exclusive, royalty-free license, which we may sub-license to our technical providers only, to host, store, reproduce, process, adapt (for example to resize or compress media), translate at your or your readers' request, publish, display and distribute Your Content, solely to operate, provide and improve Pulpe and to show it according to your settings. This license ends when Your Content is deleted from our systems, except for copies shared by others that they have not deleted, backups kept for a limited time, and content we must keep for legal reasons.
You confirm that you have all the rights needed to post Your Content and that it does not violate these Terms or the law.
Content generated with artificial intelligence must not mislead people. Use the AI generated label when your post shows realistic images, video or audio created or substantially altered by AI.
You agree not to use Pulpe to:
We moderate content in line with these Terms and with applicable law, including the EU Digital Services Act (DSA) and the French law on confidence in the digital economy (LCEN).
Anyone can report a post, comment, story, message or account from its ••• menu. To report content you believe is illegal without an account, write to [email protected] and include: the exact link to the content, an explanation of why you consider it illegal, your name and e-mail address (except for reports of child sexual abuse material), and a statement that your report is accurate and made in good faith. We acknowledge receipt and tell you what we decided.
Depending on how serious the issue is, we may remove content or restrict access to it, reduce its visibility, add a sensitive-content warning, remove a verification badge or author status, suspend features (such as messaging or payments), or suspend or close an account. Decisions are taken by our team; we may use automated tools to detect spam and abuse, but we do not close an account on the sole basis of an automated decision.
When we restrict your content or account, we tell you, unless the law prevents it or it would compromise an investigation. We explain what was restricted, the facts and rule (or law) we relied on, whether automated means were used, and how you can challenge the decision.
You can contest a decision, or our decision not to act on your report, for 6 months by replying to our notification or writing to [email protected]. A person who did not take the original decision reviews your appeal, and we answer without undue delay. If you live in the EU, you may also turn to a certified out-of-court dispute settlement body, or go to court.
We may suspend, after a warning, accounts that frequently post manifestly illegal content, and stop processing reports from people who frequently send manifestly unfounded reports.
Our single point of contact for users and for authorities of the EU Member States, the European Commission and the European Board for Digital Services is [email protected]. You can write to us in English or French. Requests from authorities must state the legal basis of the request.
The Pulpe name, logo, cup design, software, interface and all related materials belong to Pulpe LLC or its licensors. These Terms do not grant you any right to use them, except as needed to use the Service normally. If you send us feedback or suggestions, we may use them freely and without any obligation to you.
We respect intellectual property rights and respond to notices of alleged infringement under the U.S. Digital Millennium Copyright Act (DMCA), the DSA and other applicable laws. To report content, send a notice to our designated agent at [email protected], or by mail to Pulpe LLC, Attn: Copyright Agent, 30 North Gould Street, Sheridan, WY 82801, United States. Include:
If your content was removed and you believe it was a mistake, you can send a counter-notice to the same address with your signature, the removed content, a statement under penalty of perjury that it was removed by mistake, and your consent to the jurisdiction of the federal courts of your district (or of Wyoming if you live outside the United States). We terminate the accounts of repeat infringers in appropriate circumstances.
You can stop using Pulpe and delete your account at any time from Settings → Account. We may suspend or terminate your access if you seriously or repeatedly break these Terms, if the law requires it, or if your use creates a real risk for Pulpe or for others. Except in urgent cases (for example illegal content, security risks or a legal order), we will warn you first and give you the reasons, and you can appeal as described in section 7. If we close the Service, we will give you reasonable notice so that you can retrieve your content and any wallet balance that can be withdrawn. Sections 5 (for content already shared), 12, 15, 16, 17 and 18 survive termination.
Pulpe is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not guarantee that the Service will be uninterrupted, secure or error-free, and we are not responsible for content posted by users or for third-party websites and services. This does not affect the legal guarantees you have as a consumer, which cannot be excluded.
To the fullest extent permitted by law, Pulpe LLC, its members, managers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of, or inability to use, Pulpe. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) one hundred U.S. dollars (US$100).
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or gross negligence, or any other liability that cannot be limited by law. If you are a consumer in the EU or the UK, these limitations apply only to the extent permitted by the mandatory law of your country.
If you use Pulpe for business purposes, you agree to defend, indemnify and hold harmless Pulpe LLC from any claim, loss or expense (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms or of the law. If you are a consumer, you are responsible for damage you cause through your fault, under the law that applies to you.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Before filing any claim, please contact us first at [email protected] so that we can try to resolve the dispute informally within 60 days. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming.
If you are a consumer living in the European Union or the United Kingdom, you keep the protection of the mandatory laws of your country of residence and may bring proceedings before its courts. Consumers in France may also use, free of charge, a consumer mediator; the European Commission's list of mediators is available at consumer-redress.ec.europa.eu.
We may update these Terms, for example to reflect new features or changes in the law. If a change is significant, we will notify you in the app or by e-mail at least 15 days before it takes effect. If you do not agree, you can delete your account before that date. If you keep using Pulpe after the new Terms take effect, you accept them.
